Questions About My Partner's Role

Hi, I'm new to this forum and am looking forward to hearing some responses! My "husband" and I are looking to start trying to have a baby. I'm 24 and she's 25 and we've both decided that this is the perfect time to start trying. we're both at a great place in our careers. (Technically, I'm able to stay at home when we have a child and live off of her income alone.) My partner is transgendered and therefore it was a very easy decision that I would carry the baby and we found a donor with the same nationality as her and in many ways looked like she did when she was a child. But my biggest question is, can she be named on the child's birth certificate and will she need to adopt to be the legal parent of or child. Any answers or opinions would be greatly appreciated.   • It all depends on the state in which you live. As for the birth certificate, unless she is legally recognized as male, I do not believe he will be able to be put on the birth certificate. Now, there are states like California that will allow another woman on the birth certificate. More likely, you and he will need to go through what is called a second parent adoption.

    Best way to find out for sure would be to contact an adoption attorney in your state and just get a consultation with them on what your options are.
